{"id":7953,"date":"2014-09-19T08:09:13","date_gmt":"2014-09-19T16:09:13","guid":{"rendered":"https:\/\/aksalmonalliance.org\/staging1\/?p=7953"},"modified":"2014-09-19T08:09:13","modified_gmt":"2014-09-19T16:09:13","slug":"state-of-alaska-continues-to-oppose-ballot-box-fishery-management","status":"publish","type":"post","link":"https:\/\/aksalmonalliance.org\/staging1\/2014\/09\/19\/state-of-alaska-continues-to-oppose-ballot-box-fishery-management\/","title":{"rendered":"State of Alaska continues to oppose ballot-box fishery management"},"content":{"rendered":"<h1 class=\"article-title\">State will appeal ruling allowing setnet ban initiative<\/h1>\n<div class=\"by-line\">By Molly Dischner, Alaska Journal of Commerce<\/div>\n<div class=\"share-tools\" style=\"float: right; top: auto;\"><\/div>\n<p>Published: <time datetime=\"2014-08-07 11:45\">2014.08.07 11:45 AM<\/time><\/p>\n<p>&nbsp;<\/p>\n<p>The State of Alaska will appeal a Superior Court decision to allow a ballot initiative that would ban setnets in urban areas of the state.<\/p>\n<p>The Alaska Fisheries Conservation Alliance, or AFCA, filed a ballot initiative petition last November seeking to ask voters whether to ban setnets in urban parts of the state, which would primarily impact Upper Cook Inlet setnetters.<\/p>\n<p>Lt. Gov. Mead Treadwell rejected the initiative in January, based on a state Department of Law opinion asserting that it would be a prohibited resource appropriation not allowed under the Alaska Constitution.<\/p>\n<p>In July, however, Anchorage Superior Court Judge Catherine Easter overturned Treadwell\u2019s decision, and ordered the lieutenant governor to certify the initiative and allow proponents to continue the process of gathering signatures to get the question on the 2016 ballot.<\/p>\n<p>Department of Law Assistant Attorney General Cori Mills wrote in an Aug. 5 email that the state will appeal the decision.<\/p>\n<p>\u201cThe State plans on appealing the Alaska Superior Court\u2019s decision in the set-net ban initiative case (Alaska Fisheries Conservation Alliance v. State) once the final judgment is filed,\u201d Mills wrote in an emailed statement. \u201cAlaska\u2019s Constitution requires sustainable and responsible allocation of our fisheries for the benefit of all Alaskans. The Alaska Constitution also prohibits use of the initiative process for appropriations, including appropriations of our resources. We believe the Superior Court erred in finding that the proposed ban on set-netting does not amount to an appropriation and look forward to presenting our arguments before the Alaska Supreme Court.\u201d<\/p>\n<p><em>Due to copyright law, the Alaska Salmon Alliance cannot repost full articles.
